A new transport industry - Excavated Materials Contract Determination was made by
Commissioner Connor of the Industrial Relations Committee.

Operative Dates:
Hourly Hire Rate - from 20th August 2009
Contract Rate - from 20th August

NOTE: These are minimum rates and apply only to average conditions encountered. Employers are advised to make due allowance for any conditions of any exceptional nature.

Hourly Rate - Based on axle configuration.
2 axle minimum based on 5.78m = $57.73
3 axle minimum based on 9.00m = $89.89
4 axle minimum based on 10.93m = $109.21
5 axle minimum based on 17.00m = $129.84
6 axle minimum based on 19.00m = $139.83
7 axle minimum based on 31.93m = $159.11

The contract carrier to be paid one hour travel time at the rate referred to for all appropriate configurations per day.

Contract Rate - As per the ready reckoner and measured to the next kilometre. These are minimum rates and it is the responsibility of both parties to ensure all vehicles are legally loaded.

NOTE: Hourly rates are to be paid, if through slow loading or some genuine reason it is not possible to earn on contract the equivalent hourly hire. All tolls to be paid by the hirer.

City Rate - Area bounded by Sydney City area (as defined) bounded by City Road, Cleveland Street, Dowling Street, McLaclan Avenue, Waratah Street, Elizabeth Bay and Harbour Foreshores to Pyrmont Bridge Road at Blackwattle Bay and Wentworth Park Road to Broadway.

Large Material Rate - Means material 76.2cm guage or over, measured at its maximum dimension.

Waiting Time - From the time of arrival on site by the contract carrier, to the time of departure from the site exceeds 10 minutes - time shall be compensated for at the hourly rate.

Ramp Rate - As per the ready reckoner.

Rigid Vehicles - Incline of 1 or more in 6 ARTICULATED VEHICLES - incline of 1 or more in 9. Rates for steeper grades may be negotiated, the contractor to provide a measuring device. Minimum hire of four hours, plus one hour travelling time.

Wet Weather - Contract or Hourly Hire:
(a) Appearance - 1 hour travelling time if ordered.
(b) Work Suspended - No further payment.
(c) Doubtful Weather on Site - Hourly hire to be paid for instruction to wait due to doubtful weather or site preparation.

Minimum Hire - Four hours plus one hours travelling time.

Payments - Accounts must be paid for haulage within Fourteen Days (14) of the 'procedure' month in which the work was done. These rates and conditions apply to all excavation and demolition haulage in the state of New South Wales.
